At Elements Pole Aerial Fitness we want to make sure your visit to the studio is as safe as it can be. During your visit to the studio it is a requirement that you agree to and comply with the following conditions.

Elements Pole Aerial Fitness Lawnton Pty Ltd (ABN 166 273 582 03 ) (“Elements Pole Aerial Fitness Lawnton Pty Ltd”, “Elements”, “Studio”, “we”, “us”, “our”) have adopted these Terms and Conditions of class participation which applies to all dance classes, courses, memberships and workshops booked by clients (“you”) at Elements Pole Aerial Fitness Lawnton Pty Ltd (856 Gympie Road, Lawnton QLD 4501).

“Elements” recommends that you consult with a medical or health professional whenever you start any new form of exercise, including pole dancing and aerial activities. Workouts can be strenuous on the body, particularly for ligaments and joints, so if you have had or have any existing injuries that may be of concern, we strongly encourage you to obtain medical advice and clearance for activity that may place pressure and tension on your injured region. This is especially important if you have a weakened joint structure due to past dislocation or if you are recovering from surgery involving your ligaments and/or tendons. Lower back, shoulder, wrist and knee injuries tend to be most commonly aggravated by this type of exercise.

Acknowledgement of Risk
You acknowledge that you must assess your own fitness level, ability to exercise and risk to my health by participating in any activity at “Elements”. You are aware that there is some risk involved with any exercise, and that my use of and participation in the studio and use of facilities and equipment may involve some risk. You acknowledge that any physical conditions you may have, of which I may or may not be aware, or which I may or may not have disclosed to “Elements”, may possibly be aggravated or worsened by participation. You agree to inform staff at “Elements” of all current injuries and illnesses and accept any modifications the instructor may make to the program to accommodate these conditions. You agree to accept reasonable first aid advice and attention from the instructor and fulfil any requirements for incident reports in the case of an injury or incident during my time in the studio. You participate in this class acknowledging that my participation in this activity is not without risk or danger.

You hereby assume all responsibility for the dangers in undertaking any activities in the studio and hereby release and forever discharge “Elements” and its employees, contractors or agents from all actions, suites, proceedings, claims, demands, losses, damages, penalties, fines, costs and expenses (“Claims”) howsoever arising, that you may have or may have had, arising from or in connection with my involvement in any activities in the studio or my attendance at the studio;

You hereby indemnify and shall continue to indemnify “Elements” and its employees, contractors or agents in respect of any Claims arising, as a result of or in connection with, whether caused or contributed to (either directly or indirectly) by any act of negligence or omission on my part.

You agree to abide by Elements Studio Etiquette & Rules located on the walls around the studio and website and will do all that I can to minimise the risk of harm to myself and/or others during my visit to Elements.

Intellectual property
All course content, choreography and routines taught in studio, online or performed in classes, parties, one on one sessions or performances remains copyright to “Elements”. You understand and agree that you must not use or exploit any intellectual property owned by “Elements” for personal financial gain in any manner, including but not limited to instructing or teaching pole dancing, without first obtaining the written permission from “Elements” proprietors.

Photograph or Video
You acknowledge that you may be photographed or videotaped during training and hereby consent to the use of these photographs and/or videos without compensation, on the Elements website, social pages or in any editorial, promotional or advertising material produced and/or published by “Elements”.
