TERMS & CONDITIONS

Elements Pole Aerial Fitness Lawnton Pty Ltd (ABN 166 273 582 03 ) (“Elements Pole Aerial Fitness Lawnton Pty Ltd trading as Elements Pole & Aerial”, “we”, “us”, “our”) have adopted these Terms and Conditions of class participation which applies to all dance classes, courses, memberships and workshops booked by clients (“you”) at Elements Pole Aerial Fitness Lawnton Pty Ltd trading as Elements Pole & Aerial (856 Gympie Road, Lawnton QLD 4501).

Wherever “the Studio”, “Elements” or the words “us”, “our” or “we” are referred to, it means Elements Pole & Aerial and all staff, teachers, agents, contractors, volunteers, members and representatives.

The words “you”, “your”, and “member” refer to you as a member of Elements Pole & Aerial. If you are under 18, it also includes your parent or guardian.

All communication must be done via our website contact page or direct email to lawnton@elementspoleaerialfitness.com. Phone calls, verbal and messages will not be accepted.

We may sometimes add, change or remove our Terms and Conditions. The most up to date Terms and Conditions will always apply, which you can find in studio and on our website at elementspoleaerialfitness.com

1. REFUNDS
There are no refunds, please do not ask.

2. CANCELLATIONS BY YOU

2.1 Membership Cancellation
Cancellation must be communicated via our website contact page or email directly lawnton@elementspoleaerialfitness.com, communication via message, phone or verbal is not accepted.

Notice is required to cancel your membership. Non payment or non attendance is not considered cancellation.
Once we receive your cancellation notice we will cancel your membership as at 14 days from the following Sunday from receipt of your email correspondence.

An Elements staff member will confirm the final date via email.
All fees are payable up until the final date.
You are welcome to attend classes up until the final date.
After the final date no more direct debits will be taken from your account and your membership is cancelled.

2.2 Casual Class
Cancel your position in a casual class at least 8 hours prior to the class using our booking system
If cancelled under 8 hours, a cancellation fee of $24 may be taken for members not attending or cancelling late.
There will be no refunds for cancellations under 8 hours.

2.3 Workshops
No refunds but you may transfer your position to another person.

2.4 Skill class (your pole, lyra or silks core class) –
If you cannot attend your makeup class, you are entitled to a makeup class. Makeup classes are only available while you are a financial member.

2.5 Party Cancellation
Cancellation must be via email.
Cancellation 2 weeks or more prior to your party, you will receive a refund less a $100 Cancellation Fee.
Any cancellations within 2 weeks of your confirmed party date will not be refunded.

2.6 Course Cancellation by YOU
Cancellations are not accepted once the course has started for any reason.

Up until the course start date you may transfer your spot to another person. Please email us to advise the new person’s details. All monetary transactions must take place between yourselves, it has nothing to do with Elements.

If you cancel due to injury/sickness a medical certificate is required. Elements will use Management discretion to determine whether the course may be credited to your account and used for a future course or activities.

3. CANCELLATION BY ELEMENTS

3.1 Low enrolment numbers
Minimum numbers are required to run classes, usually 4, if we do not have enough enrolled in a class or workshop or the class numbers drop the class may be either:
a. Reschedule to start at another date
b. Consolidated with another class on a different day/time
c. Add your fee to account credit to be used on other services
d. If none of the above is suitable we may refund you.

Should either of the above not suit your schedule we give you the choice of a refund or credit to account for your fees.

3.2 Classes/Workshops

The studio reserves the right to cancel classes/workshops due to reasons out of our control such as and not always instructor illness or misfortune, natural disasters, weather or elements considered out of our control or for whatever reason the studio management considers in the best interest of members and the public.

In the case where Elements cancels and depending on the impacted length of the cancellations, we may choose to
Organise makeup classes on another day or time
Ask you to join another skilled class to makeup
Partially credit fees to your account
Please note: generally casual classes will not be made up, if you are not a member and paid for a casual class we will refund or credit your account.

4. MEMBERSHIP

4.1 Membership Cooling off Period
As per Fair Trading Legislation, any Fitness Centre Membership (free or not) is entitled to a 48 hr cooling off period (from the time of signing this agreement until 48 hrs after). During this time, after being notified in writing (via email) that you wish to cancel your membership, any unused fees paid by you must be refunded.

4.2 CHANGING MEMBERSHIP, UPGRADE/DOWNGRADE
Changes to membership must be done via email with at least 2 weeks notice. You can go up or down.

Direct Debits come out on Mondays, please make sure there are funds to cover your dd otherwise there will be a $11 charge.

4.3 MEMBERSHIP HOLD/ SUSPENSION
You want to keep your place in your class but are you going on holidays or planning surgery? No problems, we just need 2 weeks notice to put your membership on hold.
Our hold/suspension details are:
All holds incur a $20 fortnightly fee
Minimum of 2 weeks per hold
Maximum of 4 weeks per hold otherwise it is considered a cancellation, please refer to cancellations.
Maximum of 6 weeks per calendar year, anything over 6 weeks requires full fees paid.
A credit for your membership fee will be added to your account, less the $20 per fortnight.

If you have injured yourself please provide a medical certificate for an immediate hold.

Hold exceptions for covid or other unexpected circumstances can be requested. Please email us and management discretion will be applied. The fee is still required

4.4 CHANGES TO MEMBERSHIP BY ELEMENTS
From time to time Elements may change Membership details. If this happens you will be given at least 14 days notification via email.

5. MAKEUP CLASSES
If you are unable to attend one of your skill classes, we offer you a Make-Up Class. You may attend another class at the same level or below under the following conditions
You must be a financial member
The make-up class must taken with 4 weeks
Subject to availability in a class
If you cannot make it to a catch up class, you will forfeit your lesson.

6. COMPLAINTS & SUGGESTIONS
If you have an issue with anything in the studio, whether it be behaviour, cleanliness, safety or have any cool ideas for the studio, please direct them to the studio manager or submit the form found on our website.

PS: We find it much easier to deal with problems and suggestions if we know about them.

7. OPEN PRACTICE & HOME POLING
Our aim at the studio is to be progressive and avoid injury at times so we recommend you do not try tricks that have not already been taught to you but if you do, please make sure you are warmed up and if you are unsure, you could always ask your instructor if they think you are ready to try this trick (please listen to your instructor, they have your best interest in mind).

8. RESPONSIBILITY
8.1 PERSONAL SAFETY
Please understand that the majority of our classes are conducted in a group fitness environment – it is your responsibility to ensure that you inform the instructor at the start of every class about any condition or injury requiring program modifications to suit your individual needs.

You must also inform the instructor if you feel any discomfort or acquire any form of injury during the class so that the program can be suitably modified or first aid action taken where required.

Staff at Elements are not able to provide you with personal medical advice and can only modify the program based on the information given to them each class by you.
8.2 Attend class

9. PROPERTY
You are responsible for and cannot hold us liable for any damage, loss or theft of any personal property that you may incur while on the premises of our studios.

10. YOUR INFORMATION
It is your responsibility to keep your personal and banking details up to date. We will send all correspondence and notices to the last address you have provided us.

11. PHOTOGRAPHY OR VIDEO
You acknowledge that you may be photographed or videotaped during training and hereby consent to the use of these photographs and/or videos without compensation, on the Elements website, social pages or in any editorial, promotional or advertising material produced and/or published by “Elements”.

12. CHANGES TO CLASS SCHEDULE
We will periodically change the timetable to keep things interesting, or to adjust to instructor availability and incorporate our 4 week intro courses. We always provide advance warning for planned timetable changes.
Unplanned changes are extremely rare, but in the event that class has to be cancelled due to sickness or other unavailability of the instructor, we will provide you with as much notice as possible in the circumstances. We will also assist you in rebooking, which may mean offering you an additional class the following week.
We require a minimum of 4 participants in order to run a class. We may cancel or reschedule classes if there are insufficient bookings. We will assist you in rebooking, which may mean offering you an additional class the following week.
Make sure we have your current mobile phone number will help us to give you notice of scheduling changes at the earliest opportunity.
